Terms of Use

These Terms govern access to the REAL PROPERTY PH website, its listing directory, foreclosure information, buyer requirements, calculators, articles, account functions, and inquiry forms. By using the site, you agree to use it lawfully and to provide accurate information. If you do not agree, do not use the site.

1. Information service, not a binding property offer

Listings, descriptions, asking prices, photographs, floor and lot measurements, property codes, and advertised availability are informational and may be inaccurate, incomplete, outdated, or changed without notice. Display of a property does not confirm that it remains available or that REAL PROPERTY PH is authorized to bind any owner, bank, seller, developer, or financing institution. No website display alone establishes an offer, acceptance, agency, reservation, or enforceable real estate transaction.

2. Foreclosed and bank-acquired properties

Foreclosure inventory may be based on dated institutional documents. Prices are indicative, not guaranteed. Properties may be subject to existing offers, occupancy, possessory or redemption issues, title annotations, association dues, unpaid taxes, auction rules, management approval, and sale on an “as is, where is” basis. Verify current eligibility, possession, inspection, documentary requirements, and sale conditions directly with the selling institution. REAL PROPERTY PH does not guarantee title, legal possession, status, or successful acquisition.

3. Independent due diligence

Buyers, sellers, lessors, lessees, and investors remain responsible for assessing property suitability and obtaining their own advice where appropriate. Independently verify titles and encumbrances, surveys and boundaries, zoning and building permissions, association obligations, actual possession, seller authority, tax consequences, and transaction documents. Broker assistance does not replace professional legal, tax, banking, surveying, engineering, or investment advice.

4. Inquiries, appointments, and applications

Submitting an inquiry, viewing request, home loan assistance request, or other form creates a request for contact only. It does not guarantee an appointment, lending approval, property availability, successful sale, or a business relationship. Forms require accurate contact information and acceptance of the applicable Privacy Policy. Marketing or newsletter subscriptions, where offered, are optional and separate from service inquiries.

5. Mortgage and financial tools

Calculators are illustrations based on user-provided assumptions. They are not bank quotations, property appraisals, official tax assessments, or guarantees. Financing decisions and final rates are determined by the relevant lender and may include fees, penalties, repricing, insurance, and credit checks. REAL PROPERTY PH is not a lender.

6. User accounts and acceptable use

You are responsible for safeguarding your login credentials and information submitted under your account. Do not impersonate others, submit fraudulent listings, access another user’s information, upload malicious content, scrape protected content without permission, or interfere with the site or its services. We may restrict access or remove prohibited submissions where legally appropriate.

7. Intellectual property and external services

REAL PROPERTY PH website materials, branding, compilation, editorial content, and permitted listing photos are protected by applicable intellectual-property rights. No license is granted to reproduce or commercially exploit them except as expressly authorized. Third-party listings, banks, developers, messaging applications, and external links are subject to their own terms and privacy practices; their inclusion does not imply endorsement or a partnership unless expressly stated.

8. Disclaimer and limitation of liability

To the fullest extent permitted by applicable Philippine law, this website and its information are provided on an “as available” basis without a warranty that content will be uninterrupted, error-free, current, suitable for a particular transaction, or free of all security risks. REAL PROPERTY PH disclaims responsibility for losses arising solely from reliance on unverified property information, changed asking prices, independently provided institutional data, external services, financing decisions, or failures to conduct adequate due diligence.

To the extent permitted by law, REAL PROPERTY PH shall not be liable for indirect, incidental, special, or consequential damages arising out of website use. **Nothing in these Terms excludes liability that cannot lawfully be excluded**, including liability arising from fraud, willful misconduct, gross negligence where applicable, or mandatory rights and remedies under Philippine law. Any separate signed brokerage or engagement agreement governs the obligations arising under that agreement.

9. Privacy, changes, and governing law

Personal information is handled according to our Privacy Policy. We may revise these Terms prospectively as services change, and users should check the latest version. Philippine law governs these Terms, subject to mandatory consumer, data-protection, and other applicable protections.
